Ticket Purchase Agreement, Release of Liability, Assumption of Risk, and Waiver

Please read this entire document carefully before completing your purchase. By purchasing a ticket, you are giving up certain legal rights, including the right to sue.

Every ticket holder already accepts this agreement at checkout on TicketSignup, where it must be agreed to for each person in your party. It is published here in full so you can read it before you buy, or afterwards, at your own pace. Nothing is signed or agreed to on this page.

Haunted Hallows is a ticketed walk-through haunted attraction presented as part of the Mashpee Harvest Market at Mashpee Commons, Mashpee, Massachusetts (the “Event”). The Event is produced and operated by M&M Productions in partnership with the Mashpee Chamber of Commerce, with site support from Naukabout and Mashpee Commons and vendor participation coordinated by Lemon-Aide Corporation. These parties, together with their respective owners, members, officers, directors, employees, volunteers, contractors, cast members, agents, sponsors, landlords, and insurers, are referred to collectively as the “Released Parties.”


1. Refund and Cancellation Policy

This event follows the standard industry policy: All ticket purchases are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of attendees and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my purchase is nonrefundable.

Tickets are valid only for the date and time slot selected at purchase unless otherwise stated. Late arrival, failure to attend, or leaving the attraction before completion does not entitle the ticket holder to a refund, exchange, or credit.

2. Weather and Force Majeure

Haunted Hallows is an outdoor and partially outdoor attraction. The Event may proceed in light rain, cold, wind, and other seasonal conditions. Attendees should dress appropriately for October weather on Cape Cod.

The Released Parties shall not be liable for any failure or delay in performance, and no refund shall be owed, where the Event is delayed, interrupted, shortened, postponed, relocated, or cancelled in whole or in part due to causes beyond their reasonable control, including but not limited to: severe weather, lightning, high wind, flooding, hurricane or tropical storm, fire, power or utility failure, act of God, public health emergency or governmental order, civil disturbance, labor dispute, terrorism or threat thereof, loss of site access, or any other circumstance that, in the sole judgment of the Event organizers, makes it unsafe or impractical to operate. Where reasonably possible, the organizers may in their sole discretion offer rescheduling to another available date, but are under no obligation to do so.

3. Nature of the Attraction

Haunted Hallows is designed to frighten, startle, and unsettle. By purchasing a ticket, you acknowledge and accept that the attraction may include, without limitation:

  • Live actors in costume and makeup who may approach, follow, jump out at, shout at, or come very close to you
  • Sudden loud noises, screams, sirens, air blasts, and simulated gunfire
  • Strobe lighting, flashing lights, low light, and periods of total darkness
  • Theatrical fog, haze, smoke, water spray, and other atmospheric effects
  • Confined spaces, tight passages, low ceilings, and disorienting layouts
  • Uneven, wet, muddy, sloped, or unlit ground; steps; ramps; and outdoor terrain
  • Graphic, gory, violent, and disturbing themes, imagery, and props
  • Animatronics, moving set pieces, and mechanical effects
  • Crowds, lines, and close proximity to other attendees

You may be scared. That is the point. You may scream, run, trip, fall, or react in ways you cannot predict. Actors are instructed not to intentionally touch attendees, but incidental contact may occur in tight quarters and in the dark.

This attraction is not recommended for persons who are pregnant; persons with heart conditions, high blood pressure, respiratory conditions, or asthma; persons prone to seizures or sensitive to strobe or flashing lights; persons with claustrophobia, anxiety disorders, or panic conditions; persons with mobility limitations that would make navigating uneven terrain in the dark unsafe; persons under the influence of alcohol or drugs; and young children. You are solely responsible for determining whether you are physically and emotionally able to participate. If you are unsure, do not enter.

4. Assumption of Risk

I understand that participation in Haunted Hallows involves inherent risks of personal injury, emotional distress, property damage, and in rare cases death, arising from the conditions described above and from other causes both known and unknown, including the negligence of the Released Parties, the acts or omissions of other attendees, and the condition of the premises. I knowingly and voluntarily assume all such risks, whether or not specifically listed here, and accept full personal responsibility for any injury, loss, or damage I may suffer.

5. Release, Waiver of Liability, Hold Harmless, and Indemnification

In consideration of being permitted to purchase a ticket and enter Haunted Hallows, I, on behalf of myself, my heirs, executors, administrators, assigns, and any minor for whom I am purchasing, agree as follows:

(a) Release and Waiver. I hereby release, waive, discharge, and covenant not to sue the Released Parties from and for any and all claims, demands, causes of action, damages, losses, costs, and expenses of any kind (including attorneys’ fees) arising out of or related to my presence at or participation in the Event, including but not limited to claims for bodily injury, illness, emotional or psychological distress, wrongful death, and damage to or loss of property, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by the laws of the Commonwealth of Massachusetts.

(b) Hold Harmless and Indemnification. I agree to hold harmless, defend, and indemnify the Released Parties from and against any and all claims, liabilities, damages, and expenses (including attorneys’ fees) brought by me, on my behalf, or by any third party, arising out of my own conduct, my violation of this agreement or of posted Event rules, or any injury or damage I cause to other attendees, cast members, staff, or property.

(c) Medical Treatment. I authorize the Released Parties to secure emergency medical treatment on my behalf (or on behalf of a minor in my charge) if they deem it necessary, and I accept full financial responsibility for the cost of any such treatment. I understand that no medical personnel are guaranteed to be on site.

(d) Premises. I acknowledge that the Event takes place on property not owned by the organizers and that the property owner and its affiliates are included among the Released Parties.

6. Rules of Conduct

Admission is a revocable license. Attendees who violate the following, or who in the sole judgment of Event staff pose a risk to themselves, other attendees, cast, or property, will be removed from the premises without refund and may be barred from re-entry and reported to law enforcement:

  • Do not touch the actors, props, sets, or effects. Ever.
  • No weapons of any kind, real or replica. No fireworks, lasers, or open flame.
  • No entry while visibly intoxicated or under the influence of any substance.
  • No running, pushing, shoving, or horseplay inside the attraction.
  • No flash photography, video recording, or flashlight use inside the attraction.
  • No smoking, vaping, food, or drink inside the attraction.
  • Follow all instructions from staff and cast immediately. Cast members may break character to address safety issues.
  • Stay on the marked path. Do not enter restricted or staff-only areas.
  • Costumes and masks worn by attendees are subject to inspection and may be prohibited at staff discretion.

7. Minors

Children under 18 must have this agreement accepted on their behalf by a parent or legal guardian. Children under 13 must be accompanied through the attraction by an adult at all times. The organizers recommend that children under 10 not enter Haunted Hallows and reserve the right to refuse entry to any child based on age, size, or apparent distress, without refund. The parent or guardian accepts all terms of this agreement on the minor’s behalf and agrees to indemnify the Released Parties for any claim brought by or on behalf of the minor.

8. Photo, Video, and Media Release

I understand that the Event may be photographed, filmed, and recorded, including by security cameras and by staff for promotional purposes. I grant the Released Parties the irrevocable right to use my name, image, voice, and likeness, and that of any minor in my charge, in any media now known or later developed, for promotional, commercial, and archival purposes, without compensation, notice, or approval.

9. Personal Property

The Released Parties are not responsible for lost, stolen, or damaged personal property, including vehicles and their contents. Leave valuables at home.

10. General Terms

This agreement is governed by the laws of the Commonwealth of Massachusetts. Any dispute arising under it shall be brought exclusively in the state or federal courts located in Barnstable County, Massachusetts. If any provision of this agreement is held unenforceable, the remaining provisions shall continue in full force and effect and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable. This agreement, together with posted Event rules and the ticketing platform’s terms of sale, constitutes the entire agreement between the parties regarding the Event. No oral statements by any staff member, cast member, or volunteer modify these terms.


11. Acknowledgment

I HAVE READ THIS AGREEMENT IN ITS ENTIRETY. I UNDERSTAND THAT I AM ASSUMING SERIOUS RISKS AND GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE RELEASED PARTIES FOR THEIR OWN NEGLIGENCE. I AM SIGNING THIS AGREEMENT VOLUNTARILY AND WITHOUT INDUCEMENT.

By completing this purchase, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the refund policy.
